Terms of Use
The short version: the game is free to play. Anything you buy is processed by Apple, in-game items have no cash value, and the VIP Club renews every month until you cancel it in your App Store settings.
1. Agreement
These terms are an agreement between you and SW Software LLC ("we", "us") about Muscle Money: Idle Gym Tycoon (the "Game"). By downloading or playing the Game you accept these terms and our Privacy Policy. If you do not accept them, do not use the Game.
Your licence to use the Game is also governed by Apple's Licensed Application End User License Agreement (the "Apple EULA"). If these terms and the Apple EULA disagree, these terms apply to the extent the law allows.
2. Who can play
The Game is rated 4+. If you are under the age of majority where you live, a parent or guardian must accept these terms for you and is responsible for any purchase you make.
3. Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to play the Game on Apple devices you own or control, as the Apple EULA and the App Store rules allow. You may not copy, sell, rent or redistribute the Game; reverse engineer, decompile or modify it, except where the law allows this; or remove any copyright or other notice from it.
4. In-game items
Cash, gems, Prestige, skill points, machines, rooms, cities, skins and every other in-game item ("Virtual Items") are game content, licensed to you for use in the Game. They are not money or property. They have no value outside the Game, and you cannot exchange them for money, sell them, transfer them or have them refunded by us, except where the law requires it.
Virtual Items live in your save file on your device and in your iCloud account. If you delete the Game without an iCloud copy, or reset your gym in the Game's Settings, they are gone and we cannot restore them.
5. Purchases
You can buy optional items in the Game with real money through Apple's in-app purchase. Prices appear in the Game, in your local currency, before you confirm. Apple charges your Apple Account and handles payment, receipts and refunds.

One-time purchases and an active subscription can be restored on your devices: in the Game, tap the gear icon, then Restore Purchases. Consumable items cannot be restored once used.
All sales are final except as Apple's refund policy or the law provides. To ask for a refund, go to reportaproblem.apple.com. If Apple refunds a purchase, we may remove the items it granted.
6. VIP Club subscription
- Title and length: VIP Club, one month, renewing each month.
- Price: shown in the Game before you buy, in your local currency (US$7.99 a month in the United States).
- What you get: 25 gems each day you open the Game, double the offline earnings cap, and the VIP Lounge theme, for as long as the subscription is active.
- Payment: charged to your Apple Account when you confirm the purchase.
- Renewal: the subscription renews automatically at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- Managing and cancelling: go to iOS Settings, tap your name, then Subscriptions. After you cancel, your benefits last to the end of the paid period.
- Price changes: if the price changes, Apple tells you first and, where the law or Apple's rules require it, asks you to agree before the next renewal.
7. Fair play
Play the Game as it is meant to be played. Do not use cheats, modified versions, automation or exploits to gain items or progress, and do not interfere with the Game's purchases. The Game runs on your device, so this mostly means: if you break it, we may not be able to fix it.
8. Changes to the Game
We keep improving the Game. We may add, change or remove content and features, rebalance prices, rates and rewards, and change the Virtual Items you can get, without notice or liability, except where the law says otherwise. We try hard to keep every update compatible with your saved gym. We may also stop offering the Game. If we do, we will try to give reasonable notice.
9. Ownership
The Game, its code, art, sound, music, text, names and logos belong to SW Software LLC or its licensors and are protected by law. These terms do not give you any right in them other than the licence in section 3. Muscle Money is a trademark of SW Software LLC. The Lilita One typeface is licensed under the SIL Open Font License.
10. Feedback
If you send us ideas or feedback, we may use them freely, with no duty to pay you or credit you.
11. Disclaimer
The Game is provided "as is" and "as available". To the fullest extent the law allows, we disclaim every warranty, express or implied, including fitness for a particular purpose and non-infringement. We do not promise that the Game will be free of errors or that your save will never be lost. Nothing in the Game is fitness, health or financial advice.
12. Limitation of liability
To the fullest extent the law allows, SW Software LLC is not liable for any indirect, incidental, special or consequential loss, or for any loss of data, Virtual Items or goodwill, arising from the Game. Our total liability for any claim about the Game is limited to the amount you paid for the Game and in-app purchases in the 12 months before the claim, or US$50 if that is more. Some places do not allow these limits, so they may not apply to you, and nothing here limits a right you cannot give up by law.
13. Ending these terms
You can stop at any time by deleting the Game. We may end your licence if you break these terms. Sections 4, 9, 11, 12 and 14 continue after the licence ends.
14. Law and disputes
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. If you live in the European Union, the United Kingdom or another place whose consumer laws give you rights these terms cannot remove, those rights still apply, and you may bring a claim in the courts where you live. Before any formal claim, please write to us: most problems are easy to fix.
15. Apple
These terms are between you and SW Software LLC, not Apple. Apple is not responsible for the Game or its content, and has no duty to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
16. Changes to these terms
We may update these terms. We will post the new version on this page with a new date. If you keep playing after a change, you accept the new terms. A change to the subscription terms does not affect a period you have already paid for.
